Terms and Conditions of Use - FocoLMS

This document describes the general terms and conditions applicable to the technological infrastructure provision services (the 'Services') offered by FocoLMS ('The Platform'), intended for institutions or professionals (the 'Institution') to manage their content and users.

I. Nature of Service and Responsibility

• Role of The Platform: The User understands that The Platform operates as an infrastructure provider (SaaS). The Platform does not control or pre-approve content uploaded by Institutions.
• Responsibility for Content (Tenant Administrator): The Institution or Instance Administrator holds exclusive legal responsibility for all educational materials, files, and multimedia uploaded, as well as user access management and the accuracy of data provided.
• Prohibited Content: The upload, storage, or distribution of illegal content is strictly prohibited. This includes material that violates criminal laws, promotes hate speech, infringes on third-party copyrights, or contains malicious software.

II. Personal Data Protection

• Regulatory Framework: This platform operates in compliance with Law No. 25,326 on Personal Data Protection (Argentina) and international standards of the General Data Protection Regulation (GDPR).
• Purpose of Processing: By using this LMS, the User consents to the processing of their data for: Educational Administration, Communication, Technical Optimization, and Legal Compliance.

III. Cookies and Tracking

We use essential technical cookies to maintain the session and ensure basic platform functions. Analytical cookies may be used to improve our service, subject to user consent where required by law.

IV. Payment Management and Revocation (Law No. 24.240)

• Intermediation: Course prices and conditions are established exclusively by the Institution.
• Right of Revocation: THE USER HAS THE RIGHT TO REVOKE THE PURCHASE MADE ON THE SITE WITHIN TEN (10) CALENDAR DAYS FROM THE DATE OF CONTRACTING. To exercise this right, the User may use the 'REVOCATION BUTTON' available on the Site's home page.

V. Capacity and Registration

Services are only available to persons with legal capacity. Access is via personal credentials; the User is responsible for all operations carried out on their account. The Platform is not responsible for Internet failures beyond its control.

VI. Intellectual Property

All platform software, databases, and networks are the property of The Platform and are protected by international laws. Unauthorized reproduction is strictly prohibited.
